Risk Disclosure Statement
Please read this statement carefully before enrolling in any VolumeAtPrice.com course, coaching program, or using any of our materials. It's incorporated by reference into our Terms of Service.
1. Education Only — Not Advice
VolumeAtPrice.com ("we," "us," "our," operated by VAP Education LLC) provides education about market analysis methodology — specifically the Volume at Price / Auction Market Theory approach to reading futures, equities, ETFs, options, and forex charts. We are not a registered broker-dealer, futures commission merchant, investment adviser, or any other regulated financial intermediary, and nothing in our course, coaching, emails, calculators, or any other material constitutes:
- A recommendation to buy, sell, or hold any security, futures contract, option, or currency;
- Personalized investment, trading, tax, or legal advice; or
- A solicitation of any order to buy or sell any financial instrument.
We do not know your financial situation, risk tolerance, objectives, or suitability for any particular trade or strategy, and we don't ask you to rely on us for that judgment. Always consult a qualified, licensed financial professional regarding your specific circumstances before making investment decisions.
2. Trading Is Risky — You Can Lose Money
Trading futures, options, securities, ETFs, and foreign exchange involves substantial risk of loss and is not suitable for every investor. You should carefully consider whether trading is appropriate for you in light of your financial condition. Only risk capital you can afford to lose should be used for trading, and only those with sufficient risk capital should consider trading.
- Futures and options trading involve leverage, which can magnify both gains and losses. It is possible to lose more than your initial investment.
- Stop-loss orders do not guarantee limiting your losses. In fast-moving or illiquid markets, or where a market hits a daily price limit, stop orders may execute at a materially different price than intended, or may not execute at all.
- Foreign exchange trading carries additional risks, including but not limited to leverage, limited regulatory protection, and counterparty risk.
- Past real or hypothetical performance of any methodology, strategy, or setup is not indicative of, and does not guarantee, future results.
You, and only you, are responsible for your own trading decisions and their outcomes. Neither VolumeAtPrice.com nor any instructor, coach, or affiliate will be liable for any trading losses, lost profits, or other damages arising from your use of the concepts taught in our Services.
3. Hypothetical & Simulated Performance Disclaimer (CFTC Rule 4.41)
Where any course material, worked example, chart walkthrough, or marketing content presents hypothetical or simulated trading results, the following disclosure applies in full:
CFTC RULE 4.41 — HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER-OR-OVER COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFIT OR LOSSES SIMILAR TO THOSE SHOWN.
4. Past Performance & Historical Examples
Any historical chart, worked example, backtest, or case study (including references to specific past market events, such as the May 2010 Flash Crash) is presented solely as a historical, educational illustration of how the VAP methodology can be applied to read a chart. These examples:
- Are not representative of results you should expect to achieve;
- May be selected because they clearly illustrate a concept, not because they are typical; and
- Do not account for transaction costs, slippage, taxes, or the emotional and behavioral factors involved in live trading.
Past performance — real or hypothetical — is never a guarantee or reliable indicator of future results.
5. No Guarantees
We make no guarantee, express or implied, that you will profit, that your losses will be limited, or that you will achieve any particular level of skill or trading outcome from taking our course, joining PRO, or working with a coach. Trading skill takes time, practice, and discipline to develop, and outcomes vary widely from person to person based on factors entirely outside our control — including your own risk management, discipline, capital, and market conditions.
6. Testimonials Are Not Typical
Any testimonials, student results, or success stories referenced in our marketing or course materials reflect individual experiences and are not representative of the results that any other student should expect. Trading outcomes depend on numerous personal factors (capital, risk tolerance, discipline, market conditions, execution) that vary significantly from person to person. Testimonials are not paid unless disclosed, and are not a guarantee or promise of similar results.
7. No Endorsement of Brokers or Platforms
Any reference to a specific broker, charting platform (e.g., TradingView), data vendor, or other third-party tool is for illustration only and is not an endorsement, referral, or guarantee of that provider's services. You are responsible for evaluating and choosing your own broker and platform, including understanding their fees, execution quality, and risk disclosures.
8. Your Acknowledgment
By enrolling in any VolumeAtPrice.com course or coaching program, you acknowledge that:
- You understand trading involves substantial risk of loss;
- You are solely responsible for your own trading decisions and outcomes;
- You are not relying on VolumeAtPrice.com or any instructor for personalized financial advice; and
- You have read and understood this Risk Disclosure Statement in full.
